Poke Forecast respects the intellectual property rights of others and expects users of our Site to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to notices of alleged copyright infringement reported to our designated agent.

Reporting Copyright Infringement

If you believe that content on pokeforecast.com/ infringes your copyright, please send a written DMCA notice to our designated agent at the contact below. Your notice must contain all of the following:

  1. A physical or electronic signature of the copyright owner or an authorized representative
  2. A description of the copyrighted work you claim has been infringed
  3. The specific URL(s) on pokeforecast.com/ where the allegedly infringing material appears
  4. Your name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are duly authorized to act on their behalf

We will review and act on properly submitted DMCA notices promptly, generally within 5 business days.

Counter-Notice Procedure

If you believe your content was removed in error or due to misidentification, you may submit a written counter-notice to our DMCA agent. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification
  4. Your name, address, and telephone number, and a statement consenting to jurisdiction of the Federal District Court for your district

Upon receiving a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant seeks a court order.

Repeat Infringer Policy

In accordance with the DMCA and applicable law, Poke Forecast maintains a policy of terminating, in appropriate circumstances, the access of users who are found to be repeat copyright infringers.

Pokemon & Nintendo Content

Poke Forecast does not host, reproduce, or distribute official Pokemon card images as standalone assets. Card names and market data referenced on this Site are used for identification, commentary, and market analysis purposes only, which we believe constitutes fair use under 17 U.S.C. § 107. If you represent Nintendo, Game Freak, or The Pokemon Company International and have a specific concern, please contact us directly at support@pokeforecast.com and we will respond promptly.
